APPLICATION OF THE TERMS AND CONDITIONS
The General Terms and Conditions (GTC) apply to all offers, orders, purchases and other legal transactions, deliveries and services of Hotel Capricorn AG in Zermatt.

CONCLUSION OF CONTRACT - ORDERS
(1)    Orders for vouchers are placed via the online store. Vouchers can also be purchased directly on site at reception.
(2)    Orders received by 12 noon will generally be processed on the same day. However, the Hotel Capricorn reserves the right to deviate from this procedure.
(3)    Hotel Capricorn AG undertakes to accept the customer's voucher order in accordance with the conditions on the website.
(4)    Only persons over the age of 18 are entitled to place an order.
(5)    The vouchers remain the property of Hotel Capricorn AG until full payment has been made by the purchaser.
(6)    After completing the order process, the customer will receive an e-mail with an invoice and order confirmation. This serves as the conclusion of the purchase contract.

PRICE
The prices according to the currently valid price list and product labeling in the online store apply. All prices are inclusive of VAT. Hotel Capricorn AG accepts no liability for any data errors in the online store due to slight negligence.

VOUCHER
(1)    Vouchers cannot be exchanged for cash.
(2)    An invoice with tax statement can only be issued at the time the voucher is redeemed
(3)    The voucher only becomes valid after full payment. Until then, ownership remains with Hotel Capricorn AG.
(4)    No cash redemption is possible if the value consumed is less than the value of the voucher.
(5)    Service vouchers are valid and redeemable for 2 years from the date of issue. The validity may vary depending on the offer (e.g. seasonal offers). Value vouchers are valid for 10 years from the date of issue and can be redeemed during this period.

PAYMENT OPTIONS
(1)    All orders for vouchers and goods will only be settled against payment by credit card (Master Card, Visa).
 
SERVICE PERFORMANCE & SHIPPING
(1)    The service must be provided at the time and place specified in the order and to the extent or in the quantity agreed. The performance period shall commence on the order date.
(2)    The vouchers shall be delivered by Swiss Post or by e-mail in accordance with the applicable terms and conditions.
(3)    Unless otherwise agreed, delivery shall be made from Hotel Capricorn AG, Riedstrasse 45, 3920 Zermatt to the delivery address specified by the customer.
(4)    Hotel Capricorn AG assumes no liability for delays due to postal delivery by the Swiss Post.
(5)    Delivery is only made within Switzerland.
(6)    Delivery is subject to availability. If ordered goods are not available at this time, the customer has the option of canceling the order or making a reservation for a possible subsequent delivery.
(7)    If the delivery of the ordered goods is not possible for Hotel Capricorn AG through no fault of its own, in particular because a supplier does not fulfill its contractual obligations, Hotel Capricorn AG can withdraw from the customer's/guest's order. In this case, the customer/guest will be contacted immediately.
(8)    Orders from Monday to Friday will be dispatched within 5 days.
(9)    Shipping costs Shipping of vouchers:
A Mail: CHF 4.00
B Mail: CHF 3.00

DATA PROTECTION
The customer/guest agrees that all data provided by him/her may be used by Hotel Capricorn AG or for the fulfillment of legal requirements, for the processing of payment transactions and for advertising purposes. The customer data will be treated in accordance with the currently valid data protection law and will not be passed on to third parties unless this is necessary for the fulfillment of the contract. If the customer/guest does not wish data to be used for internal purposes, the customer/guest is entitled to object to this use at any time by sending a corresponding e-mail to info@capricorn-zermatt.ch, by telephone on 0041 27 967 11 77 or in writing.

RIGHT OF WITHDRAWAL
(1)    Hotel Capricorn AG is entitled to withdraw from the contract if the customer is in default of performance (payment).
(2)    The withdrawal period begins on the day the contract is concluded, whereby Saturdays do not count as working days.
(3)    It is sufficient if the declaration of withdrawal is sent within the period without giving reasons. However, the right of withdrawal shall not apply if the use of the purchased product has already begun within the withdrawal period as agreed.
(4)    In the event of withdrawal, the purchase price shall be refunded in full or in part concurrently with the return of the goods received from the customer/guests. The costs of the return shipment shall be borne by the customer/guest.
(5)    The goods should be returned to the Hotel Capricorn in an unused and resalable condition. In the case of goods that are impaired by signs of use or whose packaging is damaged, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned.
(6)    The declaration of withdrawal is not bound to any particular form.

PLACE OF PERFORMANCE, PLACE OF JURISDICTION AND CHOICE OF LAW
(1)    Place of performance: Zermatt
(2)    This contract is subject to Swiss formal and substantive law to the exclusion of the rules of private international law (in particular IPRG and EVÜ) and the UN Convention on Contracts for the International Sale of Goods.

OTHER
(1)    Unless the above provisions provide otherwise, the running of a time limit shall commence upon delivery of the document ordering the time limit to the contracting parties who must observe the time limit. When calculating a time limit which is determined by days, the day in which the time or event falls on which the beginning of the time limit is to be based shall not be included. Time limits determined by weeks or months refer to the day of the week or month whose name or number corresponds to the day from which the time limit is to be counted. If this day is missing in the month, the last day of this month shall be decisive.
(2)    Declarations must be received by the other contracting party on the last day of the period (midnight).
(3)    In the event of loopholes, the relevant statutory provisions shall apply.
